WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

PLEASE READ THIS DOCUMENT COMPLETELY BEFORE SIGNING. ITS EFFECT IS TO RELEASE ELITE SPORTZ AND SO CAL MAGIC BASKETBALL, INC (SCMB), AND ITS OFFICERS, EMPLOYEES, AND AGENTS FROM ANY LIABILITY RESULTING FROM YOUR CHILD'S PARTICIPATION IN THE SCMB ACTIVITIES DESCRIBED BELOW, AND TO WAIVE ALL CLAIMS FOR DAMAGES OR LOSSES AGAINST ELITE SPORTZ & SCMB WHICH MAY ARISE FROM SUCH ACTIVITIES EXPRESS ASSUMPTION OF RISK ASSOCIATED WITH PARTICIPATION IN THE SPORTS ACTIVITY.

I, do hereby affirm and acknowledge That I have been fully informed of the inherent hazards and risks associated with my child's participation in any sport or training program offered by the Elite Sportz program. This Agreement shall be binding upon myself and my child, and shall be applicable to and remain in force for so long as I choose to have my child participate in the Elite Sportz program. I understand and acknowledge that the risks and hazards inherent in the activities associated with my child's participation may include personal injuries that range from relatively minor injuries to severe permanent personal injury and even loss of life. Those possible injuries include, but are not limited to, nausea, sprains, cuts, bruises, broken bones, heart attack, and other severe injury, including permanent injury or loss of life.

I recognize that the potential for injury may vary depending on the activity my child is engaging in, but I have or will have before having my child participate in any such activity considered those consequences and agree not to have my child participate without first having assumed the risks associated with that sport. While serious injury may or may not be common occurrences associated with all of the activities my child will be participating in, I recognize there is a potential for injury or other harm with each activity.

Despite the potential risks, hazards, and dangers associated with my child's participation in any intramural sport, I wish for my child to participate and freely accept and expressly assume all risks, dangers and hazards that may arise from my child's participation which could result in temporary or permanent personal injury or loss of life. I further understand that I have the option to obtain insurance for my child on my own against any such loss.

I acknowledge and agree that I and my child's, participation in the SCMB are not coerced or compelled and is solely a matter of personal interest. I, and my child am participating voluntarily, knowing it may result in injury my child or others.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:

In consideration of my child being allowed to participate in the Elite Sportz program, and promising that my child shall take due care during such participation. I hereby further agree as follows:

1.	I WAIVE AND RELEASE ANY AND ALL CLAIMS based upon negligence, active or passive, that I, my child, my estate, heirs, executors or assigns may have now or in the future against Elite Sportz, So Cal Magic Basketball program, Inc, and Mater Dei Catholic High School its trustees, directors, officers, successors, agents, assigns, servants, employees, and related persons, firms and corporations (hereinafter "releases") arising from or related in any way, to my participation in the Elite Sportz program.

2. 	I RELEASE Elite Sportz, So Cal Magic, and Mater Dei Catholic High School its trustees, directors, officers, successors, agents, assigns, servants, employees, and related persons, firms and corporations from liability and responsibility for any cause (s) of action that I, my child, my estate, heirs, executors or assigns may have for personal injury, property damage or wrongful death arising from my child's participation in the aforementioned sporting activity.
By executing this document, I agree to hold the releases, including Elite Sportz, So Cal Magic Basketball program, Inc., and Mater Dei Catholic High School harmless for any injury, harm, or loss of life which may occur to my child during his or her participation in the aforementioned activity

3. 	By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releases, including Elite Sportz, So Cal Magic Basketball program, Inc., and Mater Dei Catholic High School other than what is set forth in this agreement. I further agree that this Agreement shall be governed by and interpreted in accordance with the laws of the State of California.

4. 	If any provision, section, subsection, clause or phrase of this release if found to be unenforceable or invalid, that portion shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable portion had never been contained in this document.

5.	I FURTHER AGREE to indemnify and hold harmless Elite Sportz, So Cal Magic Basketball Program, Inc., and Mater Dei Catholic High School, its trustees, directors, officers, successors, agents, assigns, servants, employees, and related persons, firms and corporations from allloss1 costs (including attorney's fees), expense, damage, claims or liability due to my, or my child's alleged negligence or fault, including claims or liability relating to injury to others arising from or in any way related to the aforementioned activity.

I HEREBY DECLARE that I am of legal age and am competent to sign this Agreement or, if not, that my parent or legal guardian is in complete understanding and concurrence with this agreement. Further, I acknowledge that I have had an opportunity to consult with my personal legal counsel regarding this Agreement.

I HAVE READ THIS AGREEMENT, I UNDERSTAND IT, AND AGREE TO BE BOUND BY IT.

Signature of Parent or Guardian if Participant is a minor, and by their signature they, on all our behalf, hereby agree to be bound by the terms of this agreement and I release all claims that both they and I have.

The undersigned hereby agrees to be financially responsible for the participation of their child/children in the above-selected program. By signing below, the undersigned acknowledges that they will be responsible for all the above applicable fees. All monies paid towards the program are non-refundable and nor-transferable. The undersigned further agrees to defend, indemnity, and hold harmless the Elite Sportz, So Cal Magic Basketball Program, Mater Dei Catholic High School and its officers, employees and agents from and against any and all loss, liability charges, and expenses per the waiver and release of liability, assumption of risk and indemnity agreement signed herewith. The Elite Sportz, So Cal Magic Basketball Program and Mater Dei Catholic High School does not provide for accident, medical, liability, workers compensation insurance or any other insurance for program participants. As parent/Guardian, I hereby consent to emergency treatment of my minor child as a result of accident or injury. I further agree to pay any and all costs incurred as a result of said treatment. I agree to carefully inspect and satisfy myself of any facilities which my child participates in to determine that they are reasonably safe for their intended use, and agree to expressly assume the risk of participating at any such premises. I also understand that the Elite Sportz, So Cal Magic Basketball Program, and Mater Dei Catholic High School retains the right to use photos or video taken during activities for publicity purposes, and may do so without obtaining our prior consent or approval.
